CONDITIONS OF SALE
Cooper and Tanner offers an online bidding service via the-saleroom.com for bidders who cannot attend the sale.
In completing the bidder registration on www.the-saleroom.com and providing your debit card details and unless alternative arrangements are agrees with Cooper and Tanner:
1. Authorise Cooper and Tanner, if they so wish, to charge the debit card given in part of full payment, including all fees, for items successfully purchased in the auction via the-saleroom.com and
2. confirm that you are authorised to provide these debit card details to Cooper and Tanner through www.the-saleroom.com and agree that Cooper and Tanner are entitlet to ship the goods to the card holder name and card holder address provided in fulfilment of the sale.
3. Please note that by agreeing to register online with Cooper and Tanner, you agree that storage fees will be charged at £5 per lot per day 7 days after the sale date.
4. Condition/Photograph requests
Condition is not stated on any item and we are pleased to give condition reports and supply additional photographs on any lot where practical.
All requests must be received by 12pm the day prior to the sale to ensure they are responded too.
Please note that any lots purchased via the-saleroom.com live aution service will be subject to an additional 4.95% commission charge + VAT at the rate imposed on the hammer price
1. General (a) The Auctioneers do not accept responsibility for the authenticity, attribution, genuineness, origin, authorship, age, period, condition or quality of any Lot. (b) Each Lot as set out in the Catalogue, or as divided, or combined with any other Lot is sold as shown, and with all faults, imperfections, and errors of description.
2. The Auction (a) The highest bidder to be the buyer. If any dispute arises the Auctioneer shall have absolute discretion to settle it, including if he so decides, to put the disputed Lot or Lots, up for sale again. (b) All Lots are sold subject to the right of the seller, or his Agent, to bid or to impose a reserve. (c) The Auctioneers have absolute discretion to divide any Lot, to combine any two or more Lots, or to withdraw any Lot or Lots from the Sale, to refuse bids, to regulate bidding, or cancel the sale, without in any case giving any reason, or without previous notice.
3. Buyer Conditions (a) Inspection: Ample opportunity is given for inspection and each purchaser by making a bid for a Lot acknowledges that he/she has satisfied himself/herself fully bidding by inspection or otherwise as to all the Sale Conditions, the physical condition of and description of the Lot including but not restricted to whether the Lot is damaged or has been repaired. (b) Property and Risk: The property in a Lot shall not pass to the buyer until he/she has paid the purchase price in full but each Lot is at the sole risk of the purchaser from the fall of the hammer. Each purchaser shall forewith give his/her names and permanent address and if called upon to do so by the Auctioneer may require shall forewith pay such proportion of the purchase price as the Auctioneer may require. If the purchaser fails to do so, the Lot may at the Auctioneers sole discretion be put up again and re-sold. (c) Removal of Goods. No purchase shall be claimed or removed until the sale has been concluded. All Lots shall be paid for and removed at the Buyers risk and expense by the end of the second working day after the sale. If they are not paid for and removed within seven days of the Sale the Auctioneer may re-sell them by auction or privately without notice to the buyer. (d) A purchaser moving a Lot is deemed to have expressly agreed with the Vendor and/or other purchasers that he/she will not cause any damage whatsoever to the premises and/or any other Lot or article contained therein by such removal, and further if he/she should cause any damage to indemnify completely the Vendor and/or other sufferers. (e) If any buyer fails to comply with any of the above conditions the damages recoverable from the defaulter shall include all loss arising from the re-sale of the Lot, together with the charges and expenses in respect of both sales, and any money deposited in part payment shall be held by the Auctioneer against the defaulteras liability and may be appropriated in settlement of that liability.
4. Third Party Liability. Every person on the premises at any time shall be deemed to be at their own risk, and shall have no claim against the Auctioneers in respect of any accident there which may occur or injury, damage or loss howsoever caused.
5. Default. The Auctioneers disclaim responsibility for default by either the buyer or the vendor because they act as Auctioneers only and therefore do not pay out to the vendor until payment is received from the buyer.
6. Payment by Debit card in person. We are unable to take payment by Credit Cards and are unable to take payment direct from The Saleroom. Any Invoice amount over the value of £500 will need to be paid direct into our bank, details of our bank will be sent along with the Invoice after the sale.
7. Lots that are not collected within 8 weeks of the sale will be sold by Cooper and Tanner and storage costs will be re-couped by Cooper and Tanner.
